These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Q Labs LLC, a Texas limited liability company (“Q Labs,” “Company,” “we,” “us,” or “our”), operating the TripButler.ai website, mobile application, email alerts, and all related services (collectively, the “Service”).
By accessing, browsing, or using the Service in any manner — including visiting the website, creating an account, receiving email or SMS alerts, clicking affiliate links, or sharing content generated by the Service — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, you must immediately cease all use of the Service.
We reserve the right to modify these Terms at any time in our sole discretion. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms.
The Service is intended for users who are at least 18 years of age. By using the Service, you represent and warrant that you are at least 18, have the legal capacity to enter into a binding agreement, and are not barred from using the Service under applicable law.
TripButler.ai is a free, AI-powered travel deal alert and informational service. The Service uses artificial intelligence and third-party data sources to discover and deliver personalized vacation deal alerts via email and, where opted in, SMS.
TripButler is not a travel agency, tour operator, travel broker, airline, hotel, or booking platform. We do not sell, resell, or broker travel services. We do not make reservations on your behalf. All bookings are made directly between you and third-party travel providers through their own platforms. Q Labs LLC is an information service provider only.
The Service is provided at no monetary cost to users. We generate revenue through affiliate commissions earned when users book travel through third-party partner links included in our communications, and through advertising placements within deal alert emails. In accordance with the FTC Endorsement Guides (16 CFR Part 255), we disclose the following: TripButler.ai has a financial relationship with the travel booking platforms linked in our deal alert emails. When you click a link and complete a booking, we may earn a commission at no additional cost to you.
To access certain features, you must create an account by providing your email address or signing in through Google OAuth. You agree to provide accurate, current information and to keep your account updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
We reserve the right to suspend, disable, or terminate your account at any time, for any reason or no reason, with or without notice. We may also deactivate accounts that have been inactive for twelve (12) or more consecutive months, after providing 30 days' notice to the email address on file.
The Service uses artificial intelligence, including third-party large language models, to generate travel recommendations, destination intelligence, itineraries, safety information, and other content (“AI Content”). You expressly acknowledge and agree that:
Travel prices, availability, and deal information are sourced from third-party data providers and affiliate partners. All prices shown are estimates as of the time of generation and may change at any time without notice. We do not guarantee the accuracy, availability, or validity of any pricing information.
The Service displays information obtained from third-party sources, including but not limited to weather forecasts, event listings, safety ratings, visa and entry requirements, currency exchange rates, cost-of-living estimates, tipping customs, and transportation information. We do not independently verify this information and make no representations or warranties as to its accuracy, completeness, or timeliness.
We do not represent or warrant that travel to any destination, domestic or international, is advisable or without risk. Q Labs LLC is not liable for any damages, losses, injuries, or death arising from or related to travel to any destination suggested, recommended, or featured by the Service.
Links to third-party booking sites are affiliate links. We earn commissions from qualifying purchases at no additional cost to you. All bookings are made directly with third-party providers. We are not a party to any booking transaction and bear no responsibility for the terms, fulfillment, cancellation, refund, or quality of any travel product or service purchased through affiliate links.
The Service, including its software, algorithms, AI models and prompts, website design, user interface, text, graphics, logos, trademarks (including the TripButler name and all associated brand elements), email templates, destination intelligence content, and all other proprietary materials are the exclusive property of Q Labs LLC or its licensors, protected by U.S. and international intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for personal, non-commercial use. This license does not include the right to modify, copy, distribute, reproduce, reverse engineer, or commercially exploit any portion of the Service.
By submitting any content to the Service (“User Content”), you grant Q Labs LLC a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, non-exclusive, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and otherwise exploit such User Content for any purpose, including improving and training AI models, marketing, and product development.
Any feedback, suggestions, or ideas you provide regarding the Service shall be the sole and exclusive property of Q Labs LLC.
You agree not to use the Service to:
By creating an account, you consent to receive all communications from Q Labs LLC electronically. By providing your email address, you expressly consent to receive deal alert emails at the frequency you select, transactional emails related to your account, pre-trip and post-trip informational emails, and re-engagement and referral emails. Deal alert emails contain advertising from third-party partners, clearly labeled as sponsored content.
All commercial email communications comply with the CAN-SPAM Act (15 U.S.C. § 7701 et seq.). Every marketing email includes a clear, functional unsubscribe mechanism. Opt-out requests will be honored within 10 business days.
SMS alerts are opt-in only. Message and data rates may apply. Opt out at any time by replying STOP.
The Service contains links to and integrates with third-party websites and services. These are not under our control, and we are not responsible for their content, privacy practices, terms, availability, or accuracy. Your use of third-party services is at your own risk.
The Service may offer a referral program. Referral links are for personal, non-commercial sharing only. You may not use paid advertising, spam, or misleading practices to distribute referral links. Q Labs LLC reserves the right to revoke referral benefits and terminate accounts engaged in referral program abuse. Referral benefits have no cash value and are non-transferable.
The Service is provided on an “as is” and “as available” basis, with all faults and without warranty of any kind. To the maximum extent permitted by applicable law, Q Labs LLC expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or trade practice.
You assume all risk for your use of the Service and any travel decisions made based on information provided by the Service.
To the maximum extent permitted by law, in no event shall Q Labs LLC, its officers, directors, members, employees, agents, affiliates, successors, or assigns (the “Q Labs Parties”) be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including damages for loss of profits, goodwill, data, use, or other intangible losses, regardless of the theory of liability.
Total aggregate liability of the Q Labs Parties shall not exceed the greater of fifty United States dollars (US $50.00) or the total amount you have paid to Q Labs LLC in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Q Labs LLC and the Q Labs Parties from all claims, liabilities, damages, losses, costs, and fees (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of applicable law, your User Content, travel decisions based on Service information, disputes between you and third-party travel providers, or your negligence or willful misconduct.
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
You and Q Labs LLC agree that any dispute arising from these Terms or the Service shall be resolved exclusively through final and binding individual arbitration, except that either party may seek injunctive relief for intellectual property infringement. Arbitration shall be administered by the American Arbitration Association under its Consumer Arbitration Rules, in Dallas County, Texas.
You and Q Labs LLC agree that each may bring claims only in your or its individual capacity and not as a plaintiff or class member in any class, collective, or representative action.
You may opt out of arbitration by sending written notice to [email protected] within 30 days of first accepting these Terms.
These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law provisions. To the extent arbitration does not apply, you submit to the exclusive jurisdiction and venue of courts in Dallas County, Texas.
We may suspend or terminate your access at any time, for any reason, with or without notice. Upon termination, your license to use the Service immediately ceases. Sections 5, 6, 7, 12, 13, 14, 15, 16, and this Section 17 survive termination. We may modify, suspend, or discontinue the Service at any time, temporarily or permanently, without liability to you.
If you believe content on the Service infringes your copyright, send a DMCA notice to [email protected] containing: a description of the copyrighted work, identification of the infringing material, your contact information, a good faith belief statement, and a statement under penalty of perjury that your notice is accurate.
